Terms of Service

1. Service and agreement

These terms apply when you access EasyQuestionnaire or create an account. The service provides tenant-separated workspaces for questionnaires, surveys, quizzes, polls, learning content, marketplace features, analytics, automation and related APIs. An order form or written customer agreement may add service-specific terms; if it conflicts with these terms, the expressly agreed document controls.

You must be legally able to enter this agreement. If you use the service for an organisation, you confirm you have authority to bind it. Parents, schools and organisations remain responsible for determining whether use by minors is lawful and appropriately authorised.

2. Accounts and workspaces

Provide accurate account information, protect your sign-in method and promptly report suspected misuse. Do not share credentials. Workspace administrators control membership, roles, settings and content access. They are responsible for authorised instructions given to EasyQuestionnaire and for managing users when people join, change role or leave.

We may restrict access to protect users, data or the service, investigate misuse, comply with law, or enforce these terms. Hidden interface controls do not create permission: server-side access rules govern.

3. Customer content, copyright and AI

You keep rights you hold in content you upload or create. You grant EasyQuestionnaire a non-exclusive licence to host, copy, process and display that content only as needed to operate, secure and support the service and follow authorised workspace instructions. You must have the rights and lawful basis needed for submitted content.

You are responsible for ensuring that uploaded, linked, generated and published material complies with copyright, trademark, privacy and publicity rights. EasyQuestionnaire does not grant you rights in third-party material, verify that you have permission to use it, or assume responsibility for unauthorised use by you or your workspace, to the extent permitted by applicable law. We may restrict or remove material when we reasonably believe it infringes rights or when required by law. This paragraph does not exclude liability that cannot legally be excluded.

AI authoring features produce suggestions, not verified facts or decisions. Outputs may be inaccurate, biased or inappropriate. Users must review outputs before use or publication and must not use the service for unlawful, prohibited or solely automated high-impact decisions. Do not submit personal, confidential or protected material to an AI feature unless authorised and necessary.

Feedback about the product may be used to improve it, without identifying confidential customer information.

4. Plans, payments and marketplace

Current plan features, prices, currency and billing intervals appear during ordering. Stripe processes configured online payments. Taxes and payment-provider charges may apply as shown at checkout or on an agreed order. Subscription changes take effect under the terms presented when the change is confirmed.

Marketplace creators are responsible for lawful, accurate content and descriptions. Buyers receive only the access stated for the relevant item. A platform fee may apply to eligible sales; the current amount must be shown in the applicable seller or transaction flow.

Refund, cancellation and statutory withdrawal rights depend on the transaction and mandatory law. Nothing in these terms removes consumer rights that cannot be waived. The European Commission explains the EU Consumer Rights Directive, including rules for online digital content. Contact us promptly about billing disputes; this does not restrict any right to contact a payment provider or regulator.

5. Acceptable use

Do not use the service to break the law or another person's rights; upload malware; harass or deceive; gain unauthorised access; bypass usage, security or tenant controls; probe systems without written permission; scrape or overload the service; or publish content you are not entitled to use. Do not present generated content as professionally verified when it is not.

We may remove or restrict unlawful or harmful content after proportionate review. Where appropriate, we will provide reasons and a route to question the decision, subject to safety, legal and investigation limits.

6. Availability and liability

The service may change and may occasionally be unavailable. No uptime, certification, outcome, compatibility or error-free guarantee applies unless expressly agreed in writing. Course, quiz and AI content is informational and is not medical, legal, financial or other professional advice.

Each party remains liable where liability cannot lawfully be excluded, including mandatory consumer protections. Any other exclusion or cap must be reasonable under applicable law and any customer order; these terms do not invent a fixed cap unsupported by an agreed commercial contract.

7. Ending service and changes

You may stop using the service and request account closure. Workspace-controlled data may remain under the organisation's instructions, and some records may be retained for security, accounting, dispute or legal duties. We may suspend or end service for material breach, security risk, non-payment or legal necessity, with notice where reasonably possible.

We may update these terms for product, legal or security changes. Material changes will be communicated by a reasonable channel before they take effect when required. Continued use is not treated as consent where law requires another form of agreement.

8. Law, rights and contact

Mandatory Dutch and EU protections apply where their scope requires, including consumer and data-protection rights. These terms do not force arbitration, waive collective redress, or select governing law without an identified contracting entity and reviewed customer contract.
